Preamble
Thank you for renting with Europcar!
EMobG Services Germany GmbH (hereinafter EMobG) is a German company whose registered office is at Anckelmannsplatz 1, 20537 Hamburg. It is registered at the Hamburg Registry Court under number 168009.
In accordance with the current General Terms and Conditions of Employment (T&C), EMobG will have the following obligations if the Lease Agreement is entered into:
● To rent a vehicle (car or truck) to you (as defined in Section 1 below) for a period of time specified in the rental agreement (the “Rental Period”) plus any attachments you wish to rent will also be indicated in the rental agreement.
● To provide some transportation services that are included in your rental and to provide other services that are available at an additional cost.
The contractual relationship between you and EMobG is subject to the following documents:
● The rental agreement, including, if applicable, its specific terms (the terms agreed upon with you at the time of pick-up or the first day of rental)
● Your booking confirmation email (where you pre-booked the rental online or offline)
● EMobG's security and protection provisions
● List of recommended tariff and cost
● The current terms and conditions that apply to all the documents mentioned above
In the event of a contradiction between the above documents, the terms of the first document shall prevail over the subsequent documents.
1) To whom do the rental terms and conditions apply?
The Terms and Conditions will apply to you, the person paying for the rental and any associated costs (and you may also be a driver), as well as any (other) driver who is expressly mentioned in the rental agreement and is therefore authorized to do so. Driving.
The tenant mentioned in the lease agreement is responsible for paying the amounts due under the contract.
2) Who might hire and who might drive?

EMobG has complete discretion in deciding whether or not to enter into a car lease contract with a customer.
b) Who can drive? (the driver)
An authorized driver of a vehicle is any natural person who complies with all of the following requirements:
● The person is expressly mentioned and fully identified in the rental agreement; This is the renter in principle, and may also be the person who is an additional registered driver.
● The person presents a valid driver's license and a valid identity document.
● The person has held a driver's license for the required period and meets the minimum age requirements as follows (BF17 ownership period is included):

● A company driver with a "Firmenbestätigung Fahrer" is allowed to drive any EMobG vehicle without age and driving license restrictions
● A special fee is charged for drivers under the age of 23 (young driver fee). The minimum age cannot be exceeded by booking an additional young driver fee.
● The lessee is obligated upon EMobG's request to provide the names and addresses of all drivers, unless they are already mentioned in the rental contract itself. Drivers are agents for the tenant. If the vehicle is to be driven by another person (an additional driver), an additional fee will be charged for each additional driver.
c) Who is not allowed to drive a car?
None of the persons expressly mentioned/identified in the rental agreement shall be entitled to drive the vehicle. In addition, any person who cannot provide a valid identification document as described in Sections 2a and 2b.
If you allow an unauthorized person to drive the vehicle, this is a breach of the Terms and Conditions and you will be liable for any consequences that may arise as a result, including the possibility of having to compensate EMobG for damages caused by you and/or an unauthorized person.
In such circumstances, an unauthorized driver will not be covered by any of the insurance or protection products offered through EMobG. Only liability insurance (mandatory protection) will apply.
3) Where can I drive (contractual area)
The hirer and driver are not allowed to use the vehicle outside the contractual area. The contractual territory is Europe excluding the countries listed below for the respective vehicle class.
Countries prohibited for all categories of vehicles:
Albania, Baltic Republics, Bulgaria, Greece, Iceland, Romania, Serbia, Montenegro, Macedonia, Kosovo, Bosnia and Herzegovina, Moldova, Russian Federation, Malta, Ukraine, Belarus and Cyprus.
Countries prohibited in choosing a vehicle class, as well as for full-size car classes (except for minibuses of this class) and above:
Great Britain, Ireland, Italy, Croatia, Poland, Slovakia,
Slovenia, the Czech Republic and Hungary.

In the case of electric vehicles, it is your responsibility to check that rechargers are available and compatible in the countries where you plan to travel.
Please be aware that you must comply with the laws - particularly road traffic regulations and toll payment obligations - of the country in which you are driving. You as the renter and driver are responsible for all claims resulting from the vehicle owner's liability during the time of the rental.
4) Liability for the goods transported with the rental vehicle
You have been advised that EMobG does not cover goods carried in vehicles. Likewise, EMobG cannot be held liable for any loss of opportunity and intervening operating loss in the course of executing the lease.
5) What are my obligations towards the car?
o You and/or any driver must return the vehicle, its keys, accessories and documentation to EMobG at the agreed return place at the time and date specified in the rental agreement. EMobG allows a 59-minute grace period at the end of the rental. The vehicle must be returned provided that EMobG provides it to you at the start of the rental period. If you do not return the vehicle as provided above, EMobG will take all necessary measures described in these Terms and Article 11 in particular (what procedures apply when returning a vehicle?).
o If you intend to drive the vehicle outside the contractual area, you must ensure during receipt of the vehicle that the vehicle is properly equipped in accordance with the local traffic rules of the country in or through which you and/or the driver will be driving.
o You and/or the driver must drive the vehicle responsibly and in accordance with all applicable road traffic laws and regulations and you must ensure that you and/or any driver are aware of all relevant local driving regulations. You are responsible for all fees, duties, fees, fines and penalties associated with using and claiming the Vehicle from EMobG to the extent the hirer is responsible for them.
o You and/or any driver must ensure that any baggage or goods being carried in the vehicle are secured to the extent that they do not cause damage to the vehicle or pose a danger
for any traveler. Please observe current regulations regarding load safety.
You and/or any driver shall guard the vehicle with the utmost care and diligence and, in all circumstances, shall ensure that it is locked and protected with the anti-theft devices provided when parked or left unattended.
You and/or any driver should never drive when your ability to drive is impaired, particularly when you are ill or under the influence of alcohol or drugs.
You and/or any driver will be provided with a vehicle ready to drive, checked and filled with all necessary operating materials. During the rental period, you and/or any driver must refill the vehicle with the appropriate type of operating materials (such as fuel, oil, windshield fluid, and coolant) if necessary. If improper fuel has to be added, unless you can prove that the fault is attributable to a third party, you will be liable for any expenses incurred in moving the vehicle and/or repairing the damages caused by it calculated according to the rules described in the section below (damage to the vehicle). This does not apply if you can prove that the use of the wrong fuel was the fault of a third party.
As far as the electric vehicle is concerned, it must be recharged exclusively with the cables provided by EMobG for this purpose in strict compliance with the recommendations of the vehicle manufacturer.
Smoking is strictly prohibited in all vehicles. EMobG is entitled to claim a set compensation fee in each case of breach by the tenant or a third party designated by the tenant. The tenant has the right to prove that the damage did not occur or that it is significantly less than the amount of the specified fee.
You and/or any driver may not use or allow the vehicle to be used in the following ways:

While renting, you must take all necessary precautions to keep the vehicle in the same condition it was in when you acquired it. In particular, you and/or the driver are required to carry out regular inspections regarding the condition of the vehicle such as oil, water and AdBlue levels or check tire pressure.
In general, it is important to remember that when using the driving assistive devices found on certain vehicles, it is your responsibility to consult the manufacturer's manual prior to any use in order to familiarize yourself with the instructions for use, as well as the limitations and restrictions on the use of such driving assistive devices. In any case, you must always remain vigilant and in control of your vehicle.
Likewise, the range in kilometers displayed on the dashboard is an estimate that may vary depending on your driving style, load carried, road (main gradients) and use of heating or air conditioning.
Vehicles and guides are usually provided in the language of the country of registration. For more information on the use of vehicles, please contact the EMobG team or refer to the user guides available in different languages on the Internet, in case the manufacturer's documentation is not available in paper format in different languages.
6) What transportation services are included if I only rent a car?
The basic rental fee includes the following mobility services:

Collision Damage Waiver (CDW) with a discount depending on the product or depending on a different individual agreement.
At some stations, the rental price shown does not include CDW and TW. However, you can add this protection at the time of your booking by choosing
Basic, Intermediate or Premium Protection which reduces or excludes if you purchase Premium Protection your financial liability. If you choose not to add any protection to your rental, you will still be covered by the third party liability but will be personally liable for the financial consequences resulting from damage caused by you or a licensed driver to the vehicle by collision, theft or attempted theft of the vehicle.

7) What other mobility services are not included in my rental?
EMobG proposes many additional services as mentioned in the list of recommended tariffs and costs (Annex 2).
8) What is included in the price you pay?
The information you provide EMobG at the time of booking (such as the duration of the rental, your age or the age(s) of any additional driver(s)) will have an impact on the price you will pay. Thus, any change in this information may mean a change in the price. Your rental price will be the rate in effect at the time of booking or at the time of any subsequent changes to the booking.
The price you will pay includes the following costs:
o Rental fee for the vehicle for the agreed rental period (this will include the above standard mobility services)
o Any applicable bonus mileage fees (when applicable at the time the bonus mileage booking is to be made)
o Any other navigation services or add-ons you choose to add at an additional cost
o VAT (at the current rate at the time of billing)
o Any surcharges associated with you and additional drivers personally (for example, a young driver fee for drivers under the age of 23).
By contracting with EMobG, you expressly authorize EMobG to charge your Payment Instruments for any unpaid amount relating to your rental. In this regard, your express consent will be given at our station when you provide your means of payment to our Dealer prior to picking up the Vehicle.
9) What are the fees/other fees I may have to pay?

Anyway, the deposit amount will be reminded in our terminal. If you pay by credit card, the deposit takes the form of a pre-authorization from the bank. Should you require any additional information regarding the deposit, please refer to the paragraph below (Article 19 “Do I have to pay a deposit before picking up the vehicle?”)
o EMobG may also charge you various fees and charges that EMobG has to apply in relation to incidents that may have occurred during the rental period and/or how you use the vehicle. The prices (VAT included) for these fees and charges are included in the list of recommended tariffs and costs (Appendix 2) attached to your confirmation email and available from our terminal and/or on the Europcar website.

Administrative fees for handling fines or fees. The tenant is expressly entitled to prove that no loss occurred or that the loss is significantly less than the specified fee. Please note that these administrative fees are payable in addition to the related fine or fee and you are entirely responsible for the payment of such fines or fees. The truck hirer or trailer concierge is solely responsible for paying the trailer supplement as applicable.
Cleaning fee for a vehicle that is returned in unacceptable condition and/or is dirty or smelly. Extraordinary cleaning costs are calculated on a time and material basis and charged. The tenant is expressly entitled to prove that no loss occurred or that the loss is significantly less than the specified fee.
